These terms are an agreement between you and Drumbly, Inc., a Delaware corporation ("Drumbly", "we", "us"), for your use of Drumbly at https://drumbly.com. If you use Drumbly for a company, you agree for that company and confirm you may bind it. If you do not agree, do not use Drumbly.
1. What Drumbly does
Drumbly reads your website, writes a marketing strategy, drafts content with AI agents, publishes what you approve to the channels you connect, and reports results. Some features are marked early access or depend on third-party services and may change.
2. Your account
You must be 18 or older and use Drumbly for business purposes. Keep access to your email account secure, because sign-in codes are sent there. You are responsible for what happens in your workspace, including what members you invite do. Tell us at privacy@drumbly.com if you suspect unauthorised access.
3. Plans, billing and limits
- Plans. Free, Starter, Lite and Pro are described on our pricing section. Paid plans are billed in advance, monthly or annually, through Stripe, and renew automatically until cancelled.
- Cancelling. You can cancel at any time; your plan continues until the end of the period you paid for. Except where the law requires otherwise, payments are not refundable.
- Changes. We may change prices with at least 30 days' notice before your next renewal.
- Limits. Each plan includes usage limits, such as posts per month, tracked questions, manual agent runs and a monthly AI budget. When a limit is reached, the related work pauses until the next period or until you upgrade.
- Failed payments. If a payment fails and is not fixed within 7 days, your workspace moves to the Free plan.
4. Your content
You own your content: your website, the facts and documents we derive for you, drafts, edits and everything you give us ("Your Content"). You give us a licence to host, copy, process and transmit Your Content only as needed to provide Drumbly to you, including sending it to the service providers listed in our Privacy Policy. We do not use Your Content to train AI models.
You confirm that you have the rights to the websites you add and the accounts you connect, and that Your Content does not break the law or anyone's rights.
5. AI output and publishing
Drumbly's drafts, strategy and recommendations are generated by AI and can be wrong, incomplete or unsuitable. You are responsible for reviewing output before it is published. By default nothing publishes without your approval; if you turn on autopublish for a channel, you accept responsibility for what it publishes. Results such as traffic or visibility scores are measurements and estimates, not promises. We do not guarantee any rankings, traffic, leads or revenue.
6. Connected platforms
When you connect X, LinkedIn, WordPress, Google, Reddit, Slack, Telegram, WhatsApp or another service, you must follow that service's terms and rules, including any rules on disclosure, automation and self-promotion. Reddit and Hacker News drafts are never posted by Drumbly; you post them yourself. We are not responsible for third-party services or changes to them.
7. Acceptable use
Do not use Drumbly to: break any law; send spam or deceptive content; impersonate anyone; infringe others' intellectual property or privacy; add websites you are not authorised to market; attack, probe or overload our systems or other people's; bypass plan limits or security; or build a competing product from our output. We may remove content or suspend accounts that break these rules.
8. Our service
We own Drumbly, its software and its design. We give you a limited, non-transferable right to use it during your subscription under these terms. If you send us feedback, we may use it without obligation to you. We work to keep Drumbly available and secure but do not promise uninterrupted service.
9. Confidentiality and data protection
We keep Your Content confidential and handle personal information as described in our Privacy Policy. If you are subject to the GDPR or similar laws and your workspace contains personal data, our Data Processing Addendum forms part of these terms.
10. Suspension and ending
You may stop using Drumbly at any time, and ask us to delete your workspace by writing to privacy@drumbly.com. We may suspend or end your access if you materially break these terms, fail to pay, or create risk to others, giving notice where reasonable. After your account ends you can ask for an export within 30 days; after that we delete Your Content as described in our Privacy Policy.
11. Disclaimers
Except as expressly stated in these terms, Drumbly is provided "as is" and "as available", without warranties of any kind, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows.
12. Limitation of liability
To the fullest extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, and each party's total liability arising from these terms is limited to the amount you paid us in the 12 months before the claim, or US$100 if greater. These limits do not apply to your payment obligations, a party's fraud or wilful misconduct, or liability that cannot be limited by law.
13. Indemnity
You will defend and indemnify us against third-party claims arising from Your Content, your use of connected platforms, or your breach of these terms.
14. Governing law
These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. The state and federal courts located in Delaware have exclusive jurisdiction, and both parties consent to them. If you are a consumer, you keep any rights your local law gives you that cannot be waived.
15. Changes and general terms
We may update these terms; we will notify workspace owners of material changes at least 30 days before they apply, and continuing to use Drumbly after that means you accept them. These terms, the Privacy Policy and the Data Processing Addendum are the whole agreement between us about Drumbly. If a part is unenforceable, the rest stays in effect. You may not assign these terms without our consent; we may assign them in a merger or sale of our business. Failing to enforce a right is not a waiver of it.
